Terms and conditions
- Bazora is a marketplace that allows users to buy and sell products. Buyers of products are herein defined as “consumers”, sellers of products as “merchants”. Merchants list their products in “stores”.
- Bazora also enables the creation of “submarkets” for community interests. Submarkets may include products from any of the merchant stores on the Bazora platform. The creators of submarkets are herein defined as “moderators”.
- Consumers, merchants and moderators are collectively herein defined as “users” of the Bazora platform.
- Bazora does not review listings or content. Bazora has no control over, and, unless expressly provided, does not guarantee the existence, quality, safety or legality of, items advertised; the truth or accuracy of content; the ability of merchants to sell items; the ability of consumers to pay for items; or that a consumer or merchant will complete a transaction or return an item.
- Any legal claim related to an item you purchase must be brought directly against the merchant. You release Bazora from any claims related to items sold through the Bazora platform, including for defective items, misrepresentations by merchants, or items that caused physical injury (like product liability claims).
- To list products, merchants must create a Bazora merchant profile. Once created, merchants can create and edit their merchant store by logging into the Bazora merchant profile.
- Merchants are responsible for the accuracy, content and legality of any product listing in their store.
- Merchants are responsible for all taxes (including but not limited to the tax amount itself, as well as any penalties, fines, charges, or late payment interest) related to your sales on the Bazora platform.
- The listing of a product grants Bazora the listing of that product in any submarket on the Bazora platform.
- Bazora is not involved in the actual transaction between consumers and merchants. The contract for the sale is directly between consumer and merchant. Bazora and any moderator, if purchased through a submarket, are not a party to the transaction.
- Consumers are responsible for reading the full item listing before purchase of a product.
- Consumers enter into a legally binding contract to purchase an item when the transaction is complete at checkout.
- All payments on the Bazora platform are handled by Stripe, Inc.
- For any cancellations and/or returns, consumers should contact the merchant directly.
- Moderators may create a submarket on the Bazora platform for any community interest. Bazora retains the right to refuse the creation of a submarket which does not comply with these Terms and Conditions.
- To create a submarket, moderators must create a Bazora moderator profile. Once created, submarkets can be moderated by the moderator by logging into the Bazora moderator profile.
- For any purchases made through a submarket, moderators are entitled to a 50:50 split of the transaction fee on that purchase. This is paid via Stripe to the account listed in the Bazora moderator profile.
- Bazora charge a transaction fee of 5% on all purchases made through the Bazora platform. This is paid by the consumer at checkout.
- If a purchase is made through a submarket, a portion of this transaction fee is shared with the moderator of the submarket. If a purchase is made directly through a merchant store, then no moderator fee share applies.
- If you find yourself in a dispute with another user of Bazora, we encourage you to contact the other party and try to resolve the dispute amicably.
- You may terminate your profile at any time from your account settings.
- Bazora may terminate or suspend your account should we have reason to believe you or your use of the Bazora platform violate our Terms and Conditions. You do not have a contractual or legal right to continue to use the Bazora platform.
- Bazora shall not be liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us.
- Bazora may amend these Terms and Conditions at any time. Continued use of the Bazora platform after the effective date of these amended terms constitutes acceptance of them.
- If any provision of these Terms and Conditions is held to be invalid, void or for any reason unenforceable, such provision shall be struck out and shall not affect the validity and enforceability of the remaining provisions.
